1. PURPOSE AND SCOPE
The purpose of these General Terms and Conditions of Use (hereinafter the “T&Cs”) is to provide a legal framework for the terms of use of the websites published by ORIENTACTION (hereinafter the “Company”), namely:

as well as all content, services, creative works, resources, and tools accessible through them or made available by the Company, regardless of how or where they are hosted.
The following are specifically covered by these provisions:
- ORIENTACTION LE LAB's creations: games, simulators, and educational tools;
- The tests, serious games, and e-books on the E-ORIENTACTION® platform (accessible via https://www.e-orientaction.com);
- All resources, applications, and tools published or offered by the Company that, for technical reasons, are hosted on third-party domain names or platforms (for example , https://chatbotnation.com), whether they are accessible directly or via a link from the Site.
Hereinafter collectively referred to as the “Tools.”
It is expressly stated that these Terms of Use apply to all Tools and resources made available by the Company, regardless of whether they are hosted on the Site, on a subdomain of the Site, or on a third-party platform. Access to or use of a Tool hosted on a third-party domain constitutes acceptance of these Terms of Use under the same conditions. The use of certain Tools hosted on third-party platforms may, where applicable, also be subject to the specific terms and conditions of the relevant host or third-party publisher, without this affecting the application of these Terms of Use with respect to content and Tools published by the Company.
Access to the Site and/or use of the Tools constitutes the User’s full and unconditional acceptance of these Terms of Use as well as the Privacy Policy available on the Site, which forms an integral part thereof. Access to Tools that require the entry of information is only possible after the User has checked the mandatory box confirming that they have read these Terms of Use and accept their terms.
These Terms of Use may be modified or supplemented at any time by the Company. They are posted on the Website with the date of the most recent update. Users are encouraged to review them regularly.
2. DEFINITIONS
User: any person accessing the Site and/or using the Tools. The term “User” also refers to any school, university, entity, private or public organization, government agency, local authority, association, company, employer, or any provider of consulting, training, recruitment, assessment, or support services that accesses the Site, uses the Tools, or has third parties use them, in a school, university, commercial, professional, academic, or institutional context.
Individual: any natural person who uses the Tools solely for personal and private use, for strictly non-professional and non-profit purposes.
Professional / Institution: any individual or legal entity engaged in commercial, professional, craft, industrial, academic, scientific, nonprofit, administrative, or institutional activities.
Tools: creations by ORIENTACTION LE LAB (games, simulators, educational tools), all tests, serious games, and e-books on the E-ORIENTACTION® platform (https://www.e-orientaction.com), as well as all resources, applications, and tools published or offered by the Company, whether hosted on the Site, on one of its subdomains, or on a third-party platform (for example https://chatbotnation.com).
License: prior written authorization issued by the Company, or a paid subscription or usage right, granting the right to a specific use of the Tools beyond the personal and private use reserved for Individuals.
3. CONTENT AND SCOPE OF THE SITE
The Website and the data, information, and documents it provides are intended solely to offer general, non-exhaustive information about the ORIENTACTION network and its activities. Under no circumstances should they be considered as constituting advice regarding training, career guidance, or professional support.
The information published on the Site is provided for informational purposes only and is subject to change. The User is solely responsible for his or her use of the Site, the Tools, and the information contained therein. The Company shall not be held liable for any direct or indirect damages resulting from such use, nor for any damages resulting from fraudulent intrusion by a third party that has led to a modification of the published information.
4. ACCESS AND AVAILABILITY
The Site and the Tools are generally accessible 24 hours a day, 7 days a week. The Company uses reasonable means at its disposal to ensure high-quality access, without being bound by an obligation of result.
The Company reserves the right to make any changes or improvements to the Tools at its discretion, as well as to temporarily suspend access to the Site or the Tools, particularly for maintenance purposes. The Site may also be unavailable, modified, or discontinued, either temporarily or permanently, without such events giving rise to any right to compensation. This provision also applies to the Tools hosted on third-party platforms, the availability of which may depend on the relevant third-party host or publisher.
5. INTENDED USE OF THE TOOLS – FOR PRIVATE USE ONLY
Access to the Tools (created by ORIENTACTION LE LAB, the E-ORIENTACTION platform , and resources hosted on third-party platforms) is reserved exclusively for Individuals, for their personal and private use.
Any commercial, academic, university, professional, institutional, or administrative use of the Tools is strictly prohibited, unless the user has obtained a prior written license from the Company or has paid the fee corresponding to the intended use.
The following are prohibited, among other things, without a license or prior payment:
- The use of the Tools to facilitate or enhance training sessions, workshops, classes, seminars, or conferences;
- Their use in connection with consulting, assessment, career guidance, recruitment, evaluation, or coaching services, whether provided free of charge or for a fee;
- Their use for scientific research, academic purposes, or publication;
- Their use in a school or university setting;
- Their provision by a company, government agency, local government, association, or any other organization for the benefit of its employees, staff, members, subscribers, pupils, students, users, or customers.
The User further agrees not to license, sublicense, sell, resell, rent, lend, transfer, distribute, broadcast, host, reproduce, adapt, modify, translate, decompile, incorporate, or make available to third parties, whether for free or for a fee, all or any part of the Tools.
Professionals and institutions wishing to make authorized use of the Tools are invited to purchase a license or a paid subscription from the Company at contact@orientaction.com; failure to do so will result in liability under the terms of Article 6 below.
6. USER OBLIGATIONS AND PENALTIES
The User warrants that the information provided is accurate. The User agrees to comply with these Terms of Use and to use the Tools solely for strictly personal and private purposes as an individual, and therefore agrees not to use them for any unauthorized commercial, academic, or institutional purposes.
Any violation of any of the prohibitions set forth in Articles 5 and 6 shall automatically result in the imposition of a penalty of €1,000 per confirmed violation — that is, for each connection to a Tool resulting in its fraudulent use and/or use contrary to these terms and conditions — without prejudice to the Company’s right to seek full compensation for its damages in court if such damages prove to be greater, as well as the cessation of the unlawful use.
7. INTELLECTUAL PROPERTY
The general structure of the Site and the Tools, as well as all of their constituent elements—including content, graphic design, text, visuals, photographs, logos, code, interfaces, game mechanics, educational content, quizzes, scoring systems, and algorithms—are the exclusive property of the Company and/or Dr. Emeric Lebreton, or have been authorized for use by them. This protection applies regardless of where the Tools are hosted, including when they are accessible via a third-party platform.
In particular, the following trademarks and products are protected: ORIENTACTION®, ORIENTACTION LE LAB, E-ORIENTACTION®, Harmony®, Sens®, Préférences®, Needs® pro, as well as all games, simulators, tests, serious games, e-books, and educational tools.
Any reproduction or representation, in whole or in part, of the Site, the Tools, and/or their constituent elements, by any means whatsoever and without the Company’s express authorization, is prohibited and constitutes an infringement punishable under Articles L. 335-2 et seq. of the Intellectual Property Code.
Any act of infringement shall be subject to a criminal penalty of €10,000 per confirmed violation, without prejudice to the Company’s right to seek full compensation for its damages in court if such damages exceed this amount. Given their confidential nature, the structure, scoring scales, and algorithms of the tests constitute a trade secret, the disclosure of which is strictly prohibited.
8. HYPERLINKS AND COOKIES
The Company assumes no liability for the pages to which any outgoing hyperlinks on the Site may lead, as the Company has no control over those pages.
Browsing the Site may result in the installation of cookies, subject to the User’s choice. The procedures for managing cookies and processing the associated data are detailed in the Privacy Policy available on the Site.
9. PERSONAL DATA
The processing of personal data carried out in connection with the use of the Site and the Tools is described in the Privacy Policy, which is available on the Site and forms an integral part of these Terms of Use. Such processing is conducted in accordance with Law No. 78-17 of January 6, 1978, and Regulation (EU) 2016/679 (GDPR). 10. LIMITATION OF WARRANTY AND LIABILITY
Users are advised that the tests, games, and personal and professional development tools are not an exact science and cannot be equated with psychoanalysis or psychotherapy. The information derived from them should be treated with caution and discretion and does not constitute entirely reliable or sufficient grounds on which to base a decision.
Under no circumstances may the Company be held liable, on any grounds whatsoever, for the content and/or results of the Tools. As a mere publisher of content, the Company does not guarantee the quality of the Internet or uninterrupted access to the Site and the Tools. The Company shall not be held liable for any disruption or damage related to communication networks, nor for any event of force majeure.
11. EVIDENCE AGREEMENT
Pursuant to Articles 1366 et seq. of the Civil Code, the User acknowledges and agrees that the information provided via the E-ORIENTACTION® platform and by email shall be deemed authentic between the User and the Company. Proof of the time, content, and conditions of transmission or receipt of email messages may be established by data and documents generated by the Company’s computerized systems.
12. GOVERNING LAW – DISPUTES
These Terms of Use are governed by French law. In the event of a dispute regarding their validity, interpretation, or enforcement, or regarding the use of the Site and the Tools, the parties shall endeavor to reach an amicable resolution. Failing that, any dispute shall be submitted to the Paris Commercial Court.
