Regulations in compliance with the decree of October 23, 1991.
These rules are valid in all ORIENTACTION offices in France and mainland France.

General Conditions of Application

Article 1:

These regulations have been drawn up in accordance with the provisions of articles L 6352-3 and L. 6352-4 and R 6352-1 to R 6352-15 of the French Labor Code.
These rules apply to all trainees, for the entire duration of the training course.

Health & Safety

Article 2:

Preventing the risk of accidents and illness is imperative, and requires everyone to comply fully with all applicable health and safety regulations. To this end, the general and specific safety instructions in force within the organization, where they exist, must be strictly adhered to, on pain of disciplinary action.

General discipline

Article 3:

It is strictly forbidden for trainees to :

  • Entering the establishment while intoxicated.
  • Bringing alcoholic beverages onto the premises.
  • Leaving the course without a reason.
  • Take away an object without written authorization.
  • Use company equipment, particularly computer equipment, without prior authorization.

Sanctions

Article 4:

Depending on the nature and seriousness of the misconduct, the director of the training organization or his or her representative may impose one or more of the following sanctions, in order of importance:

  • Written warning from the director of the training organization or his representative.
  • Blame.
  • Permanent exclusion from the course.

Disciplinary guarantees

Article 5:

No penalty may be imposed on a trainee without the latter being informed at the same time, in writing, of the grievances against him/her.

Article 6:

When the director of the training organization or his representative is considering imposing a sanction, he will summon the trainee by registered letter with acknowledgement of receipt, or by hand-delivered letter with acknowledgement of receipt, indicating the purpose of the summons, the date, time and place of the interview, unless the sanction envisaged is a warning or a sanction of the same nature which has no immediate impact on the trainee's presence for the remainder of the training course.

Article 7:

During the interview, the trainee may be assisted by a person of his/her choice, either a trainee or an employee of the organization. The summons referred to in the previous article shall mention this option. During the interview, the reason for the envisaged sanction is indicated to the trainee, whose explanations are sought.

Article 8:

Sanctions may not be imposed less than one clear day or more than 15 days after the interview or, where applicable, after the Disciplinary Committee's opinion has been forwarded. The trainee is notified of the penalty in writing, with reasons, by recorded delivery or registered letter.

Article 9:

When an act considered to be misconduct has led to the need for a temporary exclusion with immediate effect, no definitive sanction relating to this act may be taken without the trainee having first been informed of the grievances against him/her and, if applicable, having been invited to an interview and given the opportunity to be heard by the disciplinary committee.

Article 10:

The director of the training organization informs the employer, and where applicable the joint body paying the training costs, of the sanction taken.

Trainee representation

Article 11:

For each training course lasting more than 500 hours, a full delegate and a deputy delegate are elected simultaneously in a two-round uninominal ballot.
All trainees are eligible to vote, with the exception of prisoners admitted to vocational training.

Article 12:

The director of the training organization organizes the ballot, which takes place during training hours, no earlier than 20 hours and no later than 40 hours after the start of the course. If trainee representation cannot be ensured, the director draws up a statement of default and forwards it to the regional prefect with territorial jurisdiction. Delegates are elected for the duration of the internship. Their functions end when they cease, for whatever reason, to take part in the course. If the titular delegate and alternate delegate have ceased their functions before the end of the training period, a new election is held in accordance with the conditions laid down in articles R.6352-9 to R.6352-12.

Article 14:

Delegates make any suggestions they can to improve the running of courses and trainees' living conditions in the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions and to the application of internal regulations.

Article 15:

In the case of remuneration files, the trainee is responsible for the elements and documents submitted to the Center, and for proving their authenticity.

Advertising the regulations

Article 16:

A copy of these rules is available on the ORIENTACTION website. Each trainee must read these rules when signing the training contract or agreement.
