General provisions

By using the Site, the User, defined as any person accessing and using the Site, agrees to the collection and use of his/her data, personal or otherwise, as described in this Privacy Policy.

The expression "personal information" refers to "information which enables, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies" (article 4 of law no. 78-17 of January 6, 1978).

In the event of an update/modification of the Privacy Policy, the latter will be posted on the Site with the last update date.

The User should therefore check the Site regularly to remain informed of any changes or updates to the Privacy Policy.

 

Collection and processing of personal data

The Site ensures that the User's personal information is collected and processed with respect for privacy, in accordance with the French Data Protection Act no. 78-17 of January 6, 1978, and the EU Data Protection Regulation 2016/679 (RGPD).

Users visiting the Site remain anonymous in principle.

The technical information collected during browsing is used to analyze User behavior and usage of the Site, in order to improve the User experience.

The following may be collected: the URL of links via which the User has accessed the Site, the User's access provider, the User's Internet Protocol (IP) address.

All technical data is collected and processed solely for the following purposes:

  • Accessing, using and improving navigation on the Site ;
  • Fight against computer fraud (spamming, hacking...) ;
  • Encourage sales contacts;
  • Communication campaigns (mailing);
  • Send electronic newsletters and other information material.

Where certain personal information is mandatory in order to access specific functionalities of the Site, this mandatory nature is indicated at the time the data is entered.

If the User refuses to provide this information, he/she will not have access to certain services, functions or sections of the Site.

The User's personal data is only collected if he agrees to provide it in order to use the following features of the Site:

Contact form :

  • Program download" form : the User downloads the program for a service offered by ORIENTACTION®.
  • Contact an advisor" form: the User requests to be contacted by an advisor by filling in this form (surname, first name, email address, telephone number, type of service he/she is interested in, zip code, reason for request).
  • Call me back" form: the User asks to be called back by an advisor by filling in this form (name, first name, email address, telephone number, type of service he/she is interested in, zip code, preferred time to be called back, reason for request).
  • Contact us" form: the User requests to be contacted by filling in this form (Last name, First name, Email, Telephone, Type of service he/she is interested in, zip code, reason for request).

The purpose of processing the data collected when filling in the various forms indicated above is :

  • Relationship management with prospects requesting to be recontacted;
  • Organization of promotional and/or information campaigns.
  • Contact us" form: the User requests to be contacted by filling in this form (surname, first name, email address, telephone number, type of service in which he/she is interested, zip code, current professional situation, desire for investment in training, time available for the activity, personal and professional objectives, start date for the activity, validation of self-employed status, budget available to start this activity, desired location, activity of interest, User's CV).

The purpose of processing the data collected when filling in this form is to sign a partnership and subcontracting agreement.

Evaluation questionnaire :

  • Bilan de compétences" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • V.A.E. Accompaniment" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • Business start-up/takeover support" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • Expert Training" satisfaction questionnaire: this questionnaire collects first and last names, age, gender, e-mail address, telephone number and zip code.

The processing of the personal data referred to above is based on the performance of the contract entered into with the Customer and is intended to ensure the monitoring of the quality of the services provided by ORIENTACTION® and the processing of any complaints that may be made by customers.

In the event of a quality incident (poor evaluation), the personal data processed enables us to contact the person concerned again to find out more about the reasons for their dissatisfaction and, if necessary, to propose a solution.

Personal data may also be used, depending on the nature of the professional project and with the aim of helping to make it a reality, to enable ORIENTACTION® to contact the person again in order to offer a complementary service.

Tests performed via the E-ORIENTACTION® platform

The Site also includes access to the E-ORIENTACTION® testing and support platform. The E-ORIENTACTION® platform provides users with tests, questionnaires and teaching aids. These tests, questionnaires and teaching aids can be used either as part of the services offered by ORIENTACTION® (skills assessment, career assessment, recruitment, etc.), or on a voluntary basis. This platform comprises three modules:

  • Minor tests: these are questionnaires designed to improve self-awareness, decision-making and action. They are not the result of scientific research and are limited in scope. They are freely available.

The data corresponding to the user's responses to the above-mentioned tests is processed for the following purposes:

  • Organization of promotional and/or information campaigns,
    Statistical processing for scientific or technical research purposes.
  • Major tests: these are psychological tests designed to improve our knowledge of a person's personality, needs, talents or values. These tests are the product of scientific research. They are used to help a person choose a career path, to assess a person's suitability for a job as part of a recruitment procedure, to evaluate a person's psychological compatibility with another person as part of team coaching or therapy.

The data corresponding to the User's responses to the above-mentioned tests is processed for the following purposes:

  • The psychological evaluation of a person as part of a service provided by ORIENTACTION®, either when ordered by the User him/herself or his/her legal guardians, in particular a skills assessment, an orientation assessment, V.A.E. support or business creation/takeover support, or when ordered by a third party and the User expressly agrees to carry it out, as in the case of a recruitment procedure.
  • Organization of promotional and/or information campaigns,
  • Statistical processing for scientific and technical research.
  • Resources" module: these are teaching aids designed to support the provision of services, in particular skills assessment, career guidance, V.A.E. support or business start-up/takeover support. The "Resources" module is made up of various questions relating to all aspects of the User's life, including values, needs, personality and talents. The answers to these questions serve as a basis for discussion with the consultant in charge of supporting the User as part of the service. The answers are explained, detailed and clarified during an interview in line with the purpose of the service.

The data corresponding to the User's answers provided in the "Resources" module is processed for the following purposes:

  • The performance of the service by the User, whether ordered by a third party (in which case the User has given his or her express agreement to perform the service) or directly by the User,
  • The monitoring of the service provided by the User by the ORIENTACTION® department responsible for it, in order to ensure its quality and traceability,
  • Verification and control of the actual performance of the service when it is carried out with the support of a subcontracting partner consultant.
  • Statistical processing for scientific and technical research.

The data collected by the various minor and major tests and the "Resources" module are available on request via contact@orientaction.com. Given the confidential nature of the content and structure of the tests, in the sense that they may reveal a manufacturing secret, the request must be accompanied by proof of identity and supporting documentation.

Data transmission

The User is informed that certain personal data collected may be transmitted to ORIENTACTION®'s commercial partners for commercial prospecting purposes.

This transmission is only possible for data that the User has expressly consented to before being entered on the site.

Data retention

Personal data is stored on a secure server for a period of 5 years, and only for the purposes for which it was collected and processed.

Data may be processed for statistical purposes and passed on to third parties in the form of tables, graphs and texts (funder, QUALIOPI certifier, etc.), subject to mandatory anonymization.

Rules specific to the conversation of data relating to the carrying out of skills assessment :

Beneficiaries of skills assessments using the "Resources" module of the E-ORIENTACTION® platform accept that their data will be kept by ORIENTACTION for a maximum period of 3 years, in accordance with the provisions of article R.6313-7 of the French Labor Code. After this period, the data will be destroyed unless expressly requested by the User.

Privacy

Appropriate security measures are implemented by ORIENTACTION® to guarantee the confidentiality of the User's data, and in particular to prevent any access thereto by unauthorized third parties.

Access to the User's personal data is strictly limited to ORIENTACTION® and its employees, authorized by virtue of their functions, who are themselves bound by an obligation of confidentiality.

However, the data collected may, without the User's prior authorization, be communicated to third-party service providers who are responsible, in particular, for carrying out tasks necessary for the proper operation of the Site and its services. Within the framework of this execution, these service providers will themselves be contractually bound to confidentiality.

Finally, in the event of the purchase of the Site and its rights, all related data collected will be automatically transferred to the purchaser, who will in turn be bound by the same obligation of data retention and confidentiality with regard to the Site User.

The User's data rights

In accordance with current European regulations, Site Users have the following rights:

  • Right of access (Article 15 RGPD) and rectification (Article 16 RGPD), update, completeness of Users' data,
  • Right to block or delete Users' personal data (Article 17 of the RGPD), where it is inaccurate, incomplete, equivocal, out of date, or the collection, use, communication or storage of which is prohibited,
  • Right to withdraw consent at any time (Article 13-2c RGPD),
  • Right to limit the processing of Users' data (Article 18 RGPD),
  • Right to object to the processing of Users' data (Article 21 RGPD),
  • Right to portability of data provided by Users, where such data is subject to automated processing based on their consent or on a contract (Article 20 RGPD).

For any request (update, modification or deletion, etc.) concerning his/her personal data, the User may contact ORIENTACTION® by e-mail at the following address: contact@orientaction.com.

For security reasons, and in order to avoid any fraudulent request, any request sent by the User relating to his/her personal data must be accompanied by proof of identity. This proof will be destroyed once the request has been processed.

In the event of difficulties concerning the management of the User's personal data, the User may contact the Commission Nationale de l'Informatique et des Libertés (www.cnil.fr).
