1. General Provisions

By using the Site, the User, defined as any person accessing and using the Site, agrees to the collection and use of his/her data, personal or otherwise, as described in this Privacy Policy.

The expression "personal information" refers to "information which enables, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies" (article 4 of law no. 78-17 of January 6, 1978).

In the event of an update/modification of the Privacy Policy, the latter will be posted on the Site with the last update date.

The User should therefore check the Site regularly to remain informed of any changes or updates to the Privacy Policy.

2. Collection and Processing of Personal Data

The processing of personal data consists of any operation involving personal data, regardless of the method used (e.g., the collection, recording, storage, modification, access, disclosure, or erasure of data).

The Site ensures that the User’s personal information is collected and processed in a manner that respects privacy, in accordance with Law No. 78-17 of January 6, 1978, on Information Technology, Data Files, and Civil Liberties, and EU Regulation 2016/679 on data protection (GDPR).

The User data collected in connection with the use of the Site falls into the following five categories:

  • Technical data on connections and browsing;
  • Account information, when creating an account or submitting a form;
  • Data from the evaluation questionnaire;
  • Data derived from the use of tests available on the E-ORIENTACTION® platform;
  • Data from the “Resources Module” used in connection with the delivery of training services.

2.1 Technical Data on Connections and Browsing

The technical information collected while the User is browsing the Site is used to analyze the User’s behavior on the Site and how the User uses it, in order to improve the User’s experience.

The following may be collected: the URL of links via which the User has accessed the Site, the User's access provider, the User's Internet Protocol (IP) address.

All technical data is collected and processed for the following purposes:

  • Improving access to, use of, and navigation on the Site;
  • Fight against computer fraud (spamming, hacking...) ;
  • Compilation of statistics to gain a better understanding of user expectations regarding the Site’s sections and ORIENTACTION® products and services.

The legal basis for processing this type of data is ORIENTACTION®’s legitimate interest within the meaning of Article 6 of the GDPR.

2.2 Account and/or Form Data

When certain personal information is required to access specific features of the Site, this requirement is indicated at the time the data is entered. This is particularly the case when creating an account that allows the User to access their personal account.

If the User refuses to provide this information, they will not have access to certain services, features, or sections of the Site and will not be able to create an account.

The User’s personal data is collected only if the User agrees to provide it when using the following features of the Site:

  • Program download" form : the User downloads the program for a service offered by ORIENTACTION®.
  • "Contact an Advisor" Form: The User requests to be contacted by an advisor by filling out this form (Last Name, First Name, Email, Phone Number, Type of service they are interested in, ZIP Code, reason for their request).
  • "Call Me Back" Form: The User requests a callback from a representative by filling out this form (Last Name, First Name, Email, Phone Number, Type of service they are interested in, ZIP Code, preferred time to be contacted, reason for the request).
  • "Contact Us" Form: The User requests to be contacted by filling out this form (Last Name, First Name, Email, Phone Number, Type of service they are interested in, ZIP Code, reason for their request).

The purpose of processing the data collected when filling in the various forms indicated above is :

  • Relationship management with prospects requesting to be recontacted;
  • Conducting fundraising campaigns;
  • Organizing promotional and/or informational campaigns, particularly through communication campaigns (email campaigns/newsletters).

The legal basis for processing this type of data is the User’s consent and ORIENTACTION®’s legitimate interest within the meaning of Article 6 of the GDPR.

  • "Contact Us" Form: The User requests to be contacted by filling out this form (Last Name, First Name, Email, Phone Number, Type of service they are interested in, ZIP Code, current employment status, willingness to invest in training, time available for the business, personal and professional goals, desired start date for the business, confirmation of self-employed status, budget available to start this business, desired location, business of interest, User’s resume).

The purpose of processing the data collected when this form is completed is to manage the signing of a partnership and subcontracting agreement.

The legal basis for processing this type of data is the User’s consent.

2.3 Data from evaluation questionnaires

As part of its services, ORIENTACTION® provides its clients with the following assessment questionnaires:

  • Bilan de compétences" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • V.A.E. Accompaniment" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • Business start-up/takeover support" satisfaction questionnaire: this questionnaire collects the User's surname, first name, age, gender, e-mail address, telephone number, zip code and current employer.
  • Expert Training" satisfaction questionnaire: this questionnaire collects first and last names, age, gender, e-mail address, telephone number and zip code.

The processing of the personal data referred to above is based on the performance of the contract entered into with the Client and is intended to ensure the monitoring of the quality of the services provided by ORIENTACTION® and the handling of any complaints that may be raised by clients. The legal basis for this processing is the performance of the contract.

The personal data processed thus makes it possible, in the event of a quality issue (poor rating), to contact the individual again to better understand the reasons for their dissatisfaction and, if necessary, offer a solution.

Personal data may also be used, depending on the nature of the professional project and with the aim of helping to make it a reality, to enable ORIENTACTION® to contact the person again in order to offer a complementary service.

2.4 Data from Tests Conducted via the E-ORIENTACTION® Platform

The Site provides access to the E-ORIENTACTION® testing and support platform. The E-ORIENTACTION® platform offers Users tests, questionnaires, and educational materials. These tests, questionnaires, and educational materials may be used either as part of services offered by ORIENTACTION® (skills assessments, career guidance assessments, recruitment, etc.) or on an independent basis. This platform consists of three modules:

  • Minor tests: these are questionnaires designed to improve self-awareness, decision-making and action. They are not the result of scientific research and are limited in scope. They are freely available.

The data corresponding to the user's responses to the above-mentioned tests is processed for the following purposes:

  • Organizing promotional and/or informational activities, particularly through communication campaigns (email campaigns/newsletters),
  • Statistical processing for scientific and technical research.

The legal basis for processing this type of data is the User’s consent.

  • Major tests: These are psychological tests designed to provide a better understanding of a person’s personality, needs, talents, or values. These tests are the result of scientific research. They are used to help individuals choose a career path, to assess a person’s suitability for a position as part of a hiring process, and to evaluate psychological compatibility between individuals in the context of team coaching or therapy.

The data corresponding to the User’s responses provided as part of the aforementioned tests are processed for the following purposes:

  • The psychological assessment of an individual as part of a service provided by ORIENTACTION®, whether commissioned by the User themselves or their legal guardians, including a skills assessment, a career guidance assessment, support for the recognition of prior learning (V.A.E.), or support for starting or taking over a business—or when it is requested by a third party and the User expressly agrees to undergo it, as in the case of a recruitment process,
  • The organization of promotional and/or informational campaigns,
  • Statistical processing for scientific and technical research.

The legal basis for processing data from major tests is based on the performance of the contract and the User’s consent.

  • "Resources" Module: This module consists of educational materials designed to support the delivery of services, including skills assessments, career guidance, support for the recognition of prior learning (V.A.E.), and support for starting or taking over a business. The “Resources” module consists of various questions covering all aspects of the User’s life, including their values, needs, personality, and talents. The answers to these questions serve as a basis for discussion with the consultant responsible for supporting the User as part of the service. The answers are explained, elaborated on, and clarified during an interview related to the purpose of the service.

The data corresponding to the User's answers provided in the "Resources" module is processed for the following purposes:

  • The performance of the service by the User, whether ordered by a third party (in which case the User has given his or her express agreement to perform the service) or directly by the User,
  • The monitoring of the service provided by the User by the ORIENTACTION® department responsible for it, in order to ensure its quality and traceability,
  • Verification and monitoring of the actual delivery of the service when it is performed with the support of a subcontracted partner consultant.
  • Statistical processing for scientific and technical research.

The legal basis for processing data from the “Resources” module is the performance of the contract and the User’s consent.

The data collected as part of the various minor and major tests, as well as the “Resources” module, is available upon request by emailing contact@orientaction.com. Given the confidential nature of the tests’ content and structure, which is protected by trade secret, the request must be substantiated and accompanied by proof of identity.

2.5 Data from simulators, games, serious games, and digital tools from ORIENTACTION LAB

ORIENTACTION® offers, within a space called ORIENTACTION LAB, various digital tools designed to support Users in their personal, professional, or educational reflection. These tools may take the form of simulators, games, serious games, interactive e-books, chatbots, or any other digital tool designed to aid in decision-making or self-awareness.

The data that may be collected in connection with the use of these tools includes, in particular:

  • Information provided by the User in forms or interactive interfaces;
  • The answers provided to the questions or scenarios presented;
  • The results, scores, estimates, or simulations generated;
  • Data related to browsing and the use of tools;
  • Comments or information voluntarily provided by the User.

The data collected in this manner is processed for the following purposes:

  • The provision and improvement of the simulators, games, and digital tools offered by ORIENTACTION®;
  • Personalizing the user experience;
  • Conducting statistical studies and scientific or technical research ;
  • Organizing promotional and/or informational activities, including through communication campaigns (mailings, email newsletters), subject to the User’s consent when required;
  • Proposals for benefits, training, support, or services that may meet the needs or interests expressed by the User.

The legal basis for processing this data depends on the specific circumstances:

  • With the User's consent;
  • Regarding the performance of a contract when the use of the tool is part of a service offered by ORIENTACTION®;

When the collected data is used for marketing purposes or shared with partners, such use or sharing is subject to the User’s prior and express consent under the terms set forth in Article 4 of this Privacy Policy.

3. Data Retention

3.1 With the exception of the categories of Personal Data referred to in Sections 3.2 through 3.3, your Personal Data is retained for a period of:

  • Two (2) years after the closure of your account created on the E-ORIENTACTION platform or after the end of the contractual relationship with ORIENTACTION in the event that services were provided;
  • Three (3) years after your last use of the E-ORIENTACTION platform, if you have not closed your Account but it has remained inactive—meaning you have not logged in during that period.

3.2 In accordance with the provisions of Article R.6313-7 of the Labor Code, the data contained in the documents prepared for the skills assessment are not retained after the assessment is completed, with the exception of the data in the summary document and those contained in documents for which the beneficiary has given written consent based on the need to monitor their situation; such data may be retained for a period of three (3) years.

3.3 Personal Data collected for marketing purposes is retained until the User withdraws consent or until the expiration of a three (3)-year period from the User’s last contact with ORIENTACTION®.

4. Profiling and Sharing Data with Third-Party Partners

The User is hereby informed that his or her personal data may be shared with ORIENTACTION®’s business partners for marketing purposes.

Such transmission is permitted only for data for which the User has given express consent to such transmission—by accepting the privacy policy—prior to entering the data on the website.

The data collected in connection with your use of the Site and the E-ORIENTACTION® platform may be analyzed to identify your preferences and interests in order to create a corresponding profile. This profiling is intended to enable the personalization of content offered by ORIENTACTION® and to send you personalized advertisements based on your profile. It also allows ORIENTACTION® to provide relevant profiles to its business partners when they seek to reach a specific target audience (e.g., a group of people with a particular interest).

The data may also be subject to statistical processing and transmitted to third parties in the form of tables, graphs, and text (funding agencies, QUALIOPI certifiers, etc.) after being anonymized.

5. Confidentiality

Appropriate security measures are implemented by ORIENTACTION® to guarantee the confidentiality of the User's data, and in particular to prevent any access thereto by unauthorized third parties.

Access to the User's personal data is strictly limited to ORIENTACTION® and its employees, authorized by virtue of their functions, who are themselves bound by an obligation of confidentiality.

However, the data collected may, without the User’s prior consent, be disclosed to third-party service providers responsible, in particular, for performing tasks necessary for the proper functioning of the Site and its services. In carrying out these tasks, these service providers will themselves be contractually bound to maintain confidentiality.

Finally, in the event of the purchase of the Site and its rights, all related data collected will be automatically transferred to the purchaser, who will in turn be bound by the same obligation of data retention and confidentiality with regard to the Site User.

6. User Rights Regarding Their Data

In accordance with current European regulations, Site Users have the following rights:

  • Right of access (Article 15 of the GDPR) and right to rectification (Article 16 of the GDPR), as well as the right to update and ensure the completeness of Users’ data;
  • The right to restrict the processing of or erase Users’ personal data (Article 17 of the GDPR) when such data is inaccurate, incomplete, ambiguous, or outdated, or when its collection, use, disclosure, or retention is prohibited;
  • Right to withdraw consent at any time (Article 13(2)(c) of the GDPR);
  • Right to restrict the processing of Users' data (Article 18 of the GDPR);
  • Right to object to the processing of User data (Article 21 of the GDPR);
  • The right to data portability for data provided by Users, when such data is subject to automated processing based on their consent or on a contract (Article 20 of the GDPR);

For any requests (updates, changes, or deletions, etc.) regarding their personal data, Users may contact ORIENTACTION® by email at the following address: contact@orientaction.com

For security reasons, and in order to avoid any fraudulent request, any request sent by the User relating to his/her personal data must be accompanied by proof of identity. This proof will be destroyed once the request has been processed.

If the User encounters any difficulties regarding the management of their personal data, they may contact the Commission Nationale de l’Informatique et des Libertés (www.cnil.fr)
